Filing a DMCA Takedown Notice

If you believe that any content on our website infringes upon your copyright, you may submit a written DMCA takedown notice to our designated agent. To be valid, your notice must include all of the following elements as required under 17 U.S.C. § 512(c)(3):

Our Response to Valid Notices

Upon receiving a valid and complete DMCA takedown notice, Bestlilly will:

  • Promptly review the notice and verify the claim
  • Remove or disable access to the allegedly infringing content
  • Notify the party who posted the content that it has been removed
  • Provide information about how to submit a counter-notice if applicable

We aim to process valid notices within 5–10 business days of receipt.

Filing a Counter-Notice

If you believe that content was removed from our website as a result of a mistaken or misidentified DMCA claim, you may submit a written counter-notice. A valid counter-notice must include:

  • Your physical or electronic signature
  • Identification of the content that was removed and its previous location on our site
  • A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
  • Your full name, mailing address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, the removed content may be restored at our discretion.

Repeat Infringer Policy

In accordance with the DMCA and applicable law, Bestlilly maintains a policy of terminating the accounts of users who are found to be repeat infringers of intellectual property rights.

We reserve the right to take appropriate action, including removing content and restricting or terminating access to our website, against any individual or entity found to have repeatedly infringed upon the copyrights of others.

Warning: False or Fraudulent Claims

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorney’s fees.
